Guardianships — Title 14, Arizona Probate Code

Compassionate Guidance for Minors & Incapacitated Adults

Guardianship is a powerful tool to protect loved ones who cannot manage their personal care. For minors, the court may appoint a guardian if doing so serves the child’s best interests and statutory conditions are met; formal appointment, notice, and letters of guardianship are governed by A.R.S. §§ 14‑5204 and 14‑5207. We prepare the petition, handle service, and appear at the hearing to secure prompt relief.

For adults, proceedings follow Title 14, Article 3. The petition, medical evidence, and hearing requirements appear in A.R.S. § 14‑5303; the alleged incapacitated person has rights to counsel, to present evidence, and to cross‑examine witnesses. We build the record carefully and propose the least‑restrictive plan consistent with safety and dignity.

We also advise on guardian priorities, reporting obligations, and how to modify or terminate a guardianship when circumstances change.
